The catering and food service industry is a flavorful arena with plenty of opportunity. As of 2023, the US catering market size was valued at $11.3 billion, with a projected annual growth rate of 4.5% through 2028. That's a lot of smoothies and açaí bowls!
To get started, you'll need some capital and equipment. Initial investment can range from $10,000 to $50,000, depending on your scale. Essential equipment might include:
Commercial blenders
Refrigeration units
Food prep surfaces
Portable serving equipment
Delivery vehicle
Now, let's blend up some business structure and permit information!
Business Structure: LLC or S Corp?
Choosing between an LLC and S Corp depends on your specific circumstances. Here's a quick comparison:
LLC: Offers liability protection and flexibility in management
S Corp: Provides potential tax benefits for larger operations
An LLC might be a good fit for your home-based catering business, offering personal asset protection while maintaining simplicity in operations.
Seller's Permit: Your Ticket to Legally Sell
A Seller's Permit allows you to collect sales tax on taxable sales. It's typically required for businesses selling goods or certain services. Since you're selling food and drinks, you'll likely need one.
EIN: Your Business's Social Security Number
An Employer Identification Number (EIN) is a unique identifier for your business, used for:
Opening business bank accounts
Filing tax returns
Hiring employees
Think of it as your business's social security number, but with less retirement benefits and more paperwork!
Additional Licenses and Permits
Given the nature of your business, you might need:
Food Handler's Permit
Health Department Permit
Home Occupation Permit
These ensure you're meeting health and safety standards while operating from your home kitchen.
Business Name Registration
Registering your business name protects your brand and prevents others from using it. It's like calling dibs on the last slice of cake, but with legal backing!
Final Blend
Starting a home-based catering and beverage business can be as exciting as discovering a new smoothie flavor combination. With the right structure, permits, and registrations, you'll be well-equipped to serve up success. Just make sure all your legal ingredients are properly mixed before you start pouring out those açaí bowls! |

Business RegistrationFor your catering and home-based food business, you'll likely need to register your business entity. This typically involves choosing a business structure and obtaining the necessary registration documents.
Food Service LicensesOperating a food service business requires specific licenses related to food handling and safety. These may include:
Food Handler's Permit
Food Service Establishment License
Catering License
Home-Based Business PermitsSince you're operating out of your home, you may need permits specific to home-based businesses. These could include:
Home Occupation Permit
Zoning Compliance Permit
Additional ConsiderationsDepending on the nature of your business activities, you might also need:
Event-specific permits for pop-ups
Sales tax permit for selling goods
Health Department inspections and certifications |

A(n) Catering business doing business under an assumed business name in
Niagara County
i.e. you are a business that uses a DBA doing business as trade name to trade that is other than the full legal (first and last -- full name) name of a sole proprietor or a name other than the LLC or Corporation business name need a(n)
assumed business name certificate.
E.g. you venture into a(n)
Catering
business and you give it a trade name such as "Excellence

In
NY
you need a resale ID ( AKA seller's permit) if you selling touchable items.
(A.K.A state id, wholesale, resale,
reseller certificate, about $39 for most states).
Seller's Permit
Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID.
However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a
business tax ID number. However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting
a federal tax ID number.
In addition you will need a federal and a state EIN if you will hire employees.
I.e., a NY Federal Tax Id Number ($29) and a(n) NY State Employer Tax Number
Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in
Lockport, Incorporate in NY or form a(n) NY LLC .
Filing a DBA is not required if you will set up an LLC or form a Corporation.
If you will do business under your first and last legal name you will not need to get a fictitious business name.
Also note that even using your first and last name may not help you avoid filing a DBA if the name has a suffix such as "& sons" etc.
If you do form an Food And Dining llc or incorporate (about $49 plus state fees for most states) your Catering business instead of just filing a fictitious business name (dba),
that insurs that you don't have personal liability for debts and civile liabililty arising from your business dealings and you will not have to record the Lockport business name.
In lieu of recording a Niagara County trade company name (our filing service fee includes trade name registration and newspaper legal publication for 4 weeks) you can also form a corporation in
NY or form an NY LLC (starts @ $49 plus state fee for most states & includes bylaws for the corporation and Limited Liability operating agreement for the LLC that is required to open a business bank account). .
