WHO NEEDS AN EMPLOYER IDENTIFICATION NUMBER (EIN)?  

All businesses, including online, internet, home-based or home businesses are required to apply and obtain it if:

1. You have employees (also need a state employer number if you have employees)

2. You want to open a business bank account and don't want to use your SS#,

3. Your business is a corporation, LLC, or a partnership, or you are an employer

In some states, (if you sell tangible / taxable items) you are required to get a seller's permt in addition to getting a federal tax id (if you need one).

IMPORTANT -- IF YOU ARE GETTING A SELLER'S PERMIT:

NOTE that if your business is located in MI, MD, GA, NV, or IL, you are required to obtain a federal tax id before they issue a Seller's Permit!!!

Also note: a Federal Tax ID Number is not an LLC , a   Corporation , a Seller's Permit, a Business License or  a State Employer Tax ID (EIN).

 If you are an employer, you will need a state employer number in addition to a federal tax id number.
 
These are separate filings and you may have to file if you are required by law.

Who Needs It 

Employers, Partnerships & Corporations or LLCs.
Corporations or LLCs, employers, and, in some states, those businesses that are also getting a Seller's Permit are required to obtain a Federal Tax ID (FEIN) and a Business License.

 You can use a federal tax id number as your business ID number.

Otherwise, you will need to use your social security number over the phone or the internet all the time for orders or other business identification reasons --

and your don't want your social security out there if you want to protect your identity.

Where/How to Obtain Wholesale License/Permit

First, in addition to a wholesale license ( if you need one ) , all businesses need a business license.

Second: If you are selling merchandise items, you will also need a seller's license (wholesale license).

Third: If you will be an employer, you will need a Federal Employer ID # and a State Employer ID # for employment tax withholding.
