The paperwork map for a lingerie shop

Q: I am opening a lingerie shop. Which licenses, permits and registrations may apply to me?

A: Let us walk through what your lingerie shop may need, piece by piece, so nothing surprises you on opening day.

1. Business license: A business license for a lingerie shop MAY ask whether you sell online or in person, what brands and sizes you carry and where inventory is stored.
2. Home occupation permit: A home occupation permit MAY apply if stock and packing supplies are kept at home, typically with limits on customer visits, discreet signage and delivery traffic.
3. Sales tax permit: A sales tax permit MAY be needed because intimate apparel is generally taxable, and wholesale purchases from labels call for a resale certificate.
4. Wholesale supplier account: Brands may ask for proof of a registered business before approving a retailer account.
5. Return policy statement: Because intimates are often final-sale for hygiene reasons, a written return policy may be requested.
6. Supplier invoice file: Invoices from the brands you buy from may be needed to prove stock is for resale.
7. Company papers: Name registration, LLC formation and a tax ID number are the three companions most owners add; we prepare each of them on this site.

One service fee covers more than one license. If you order a business license and it turns out you also need another one, for example a home occupation permit, we obtain both for the service fee of the business license. Annual tax and application fees charged by the govt are not part of our service fee: we find the applications and fill them out for you.

Why people love this line of work

Fit expertise earns loyal customers who return for each new size and season.

Opening day, imagined

Colette unwrapped the first silk robes for Rose & Raven Intimates and tied the license to a hanger for good luck.

What can go wrong

A shipped order is stolen and mishandled and the customer demands compensation from you.

Codes and counts

Business code (NAICS): 458110 (Clothing and Clothing Accessories Retailers), formerly 448190. This page lists 7 paperwork items for a lingerie shop, and each one is marked as something you MAY need, since we confirm which apply.

Tip: Offer a simple size guide with measurements so returns stay low.

Lingerie retail is the business where 'one size fits most' is bold optimism.

You can choose to be a(n) Selling Lingerie :

  • Sole Proprietor,
  • LLC,
  • Corporation or
  • Partnership.
After you decide and select your business entity, you need licensing.

Anderson Business Tax Registration ( Business License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) Selling Lingerie business doing business under an assumed business name in Abbeville County i.e. you are a business that uses a DBA doing business as trade name to trade that is other than the full legal (first and last -- full name) name of a sole proprietor or a name other than the LLC or Corporation business name need a(n) assumed business name certificate.   E.g. you venture into a(n) Selling Lingerie business and you give it a trade name such as "Excellence Selling Lingerie & Associates". You will need to register an assumed business name certificate.

In SC you need a resale ID ( AKA seller's permit) if you selling touchable items.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).
Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

In addition you will need a federal and a state EIN if you will hire employees. I.e., a SC Federal Tax Id Number ($29)  and a(n) SC  State Employer Tax Number

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Anderson , Incorporate in SC  or form a(n) SC LLC
.

Filing a DBA is not required if you will set up an LLC or form a Corporation. If you will do business under your first and last legal name you will not need to get a fictitious business name.
Also note that even using your first and last name may not help you avoid filing a DBA if the name has a suffix such as "& sons" etc.

If you do form an Wholesale Trade llc or incorporate (about $49 plus state fees for most states) your Selling Lingerie business instead of just filing a fictitious business name (dba), that insurs that you don't have personal liability for debts and civile liabililty arising from your business dealings and you will not have to record the Anderson business name. In lieu of recording a Abbeville County trade company name (our filing service fee includes trade name registration and newspaper legal publication for 4 weeks) you can also form a corporation in SC or form an SC LLC (starts @ $49 plus state fee for most states & includes bylaws for the corporation and Limited Liability operating agreement for the LLC that is required to open a business bank account). .
